Introduction to the CCPA’s Initiative
In a significant move aimed at protecting consumer rights, the Central Consumer Protection Authority (CCPA) of India has initiated suo motu action against 27 restaurants that have been levying a mandatory ‘service charge.’ This action comes despite clear guidelines issued by the CCPA, which were upheld by the Delhi High Court.
Immediate Refunds and Investigations
The CCPA is not only directing these restaurants to immediately refund consumers but is also launching investigations into complaints against these food outlets. The primary goal is to deter other businesses from enforcing mandatory service charges, which have been recognized as unfair trade practices.
Penalties for Non-Compliance
In its ongoing efforts, the CCPA has imposed fines of up to Rs 50,000 on at least two restaurants that have violated the guidelines. Additionally, the CCPA has mandated that these restaurants modify their billing systems to eliminate the compulsory service charge.
Identified Violators
Investigations revealed that several restaurants, including Cafe Blue Bottle in Patna and China Gate Restaurant Pvt Ltd (Bora Bora) in Mumbai, were automatically charging a 10% service charge. As a result of these findings, penalties have been enforced.
Continued Monitoring and Consumer Protection
The CCPA has stated that it is diligently monitoring complaints received through the National Consumer Helpline concerning the illegal levy of service charges. They are committed to taking strict action against any non-compliant restaurants to uphold consumer rights and combat unfair trade practices.
Conclusion: Upholding Consumer Rights
Through these actions, the CCPA aims to create a fairer dining environment for consumers, ensuring they are not subjected to mandatory charges that are not legally justified. The initiative serves as a reminder of the importance of consumer rights in today’s market.
