Overview of the Incident
In a significant development, a Goa court has extended the police remand of Saurabh and Gaurav Luthra, co-owners of the “Birch by Romeo” nightclub, by an additional five days. This decision comes in the wake of a tragic fire that resulted in the deaths of 25 individuals on December 6.
Arrest and Background
The Luthra brothers were apprehended by Goa Police on December 16 after returning from Thailand, where they had fled shortly after the incident. Their current police custody now extends until at least December 26.
New Revelations in the Case
Recent developments indicate that the Luthras allegedly forged their trade license and other official documents. Advocate Vishnu Joshi, representing the victims’ families, revealed these findings during proceedings at the Mapusa Judicial Magistrate First Class (JMFC) court.
Judicial Custody for Nightclub Partner
In addition to the Luthra brothers, Ajay Gupta, the third partner of the nightclub, has been remanded to 14 days of judicial custody. The Goa government has taken steps to initiate criminal proceedings against the involved parties for neglect and violations of safety regulations following the deadly fire.
Safety Violations and Fireworks Incident
Reports from Goa Police highlight that the nightclub organized a fireworks event that led to the catastrophic blaze. Critically, the establishment failed to implement proper fire safety equipment and other essential safety measures. Notably, the Luthras went ahead with this fire show despite being aware that the restaurant lacked emergency exit doors crucial for safe evacuation during emergencies.
Criminal Charges Filed
On December 7, police formally charged the Luthra brothers under several sections of the Bhartiya Nyaya Sanhita 2023, including sections 105, 125, 125(a), 125(b), and 287. These charges underline the severity of their alleged negligence and the gravity of the situation.
This ongoing case emphasizes the importance of adhering to safety regulations in public venues, especially in light of tragic events.
