This marks a pivotal shift towards compliance-based regulation while ensuring public health safeguards remain intact.

    Role of the Central Drugs Standard Control Organisation (CDSCO)

    The Central Drugs Standard Control Organisation (CDSCO) has issued a comprehensive guidance document detailing the eligibility criteria, timelines, and procedures for compounding offences. A designated Compounding Authority is empowered to grant immunity from prosecution in approved cases, streamlining the resolution process.

    Eligibility for Compounding

    Under the new rules, companies or individuals involved in the manufacture, import, sale, or distribution of drugs, cosmetics, or medical devices may apply for compounding. Applications can be submitted either before or after prosecution is initiated. Each request will be reviewed based on reports from the relevant licensing and enforcement authorities.

    Conditions and Limitations

    If the application for compounding is approved, the applicant must pay the stipulated compounding amount within the specified timeframe to receive immunity from prosecution. However, this protection is conditional and may be revoked if it is later determined that key information was concealed, false details were provided, or if terms were violated.
