Since the passing of Sunjay Kapur in June last year, a significant legal conflict has erupted involving his mother, Rani Kapur, and his widow, Priya Sachdev. The dispute centers around a colossal inheritance worth Rs 30,000 crore.
Rani Kapur’s Removal from the RK Family Trust
In a recent development, Priya Sachdev has removed Rani Kapur from the RK family trust. This decision has sparked a series of emotional revelations from Rani, who describes this situation as both deeply personal and exhausting. In an interview, she expressed her ongoing grief and the toll the situation has taken on her mental health.
Rani’s Emotional Turmoil
Rani shared her journey of relocating from Mumbai to Delhi, where she played an integral role in establishing both her home and the family business. She recalls a time of stability until Priya became involved in her son’s life, leading to dramatic changes in family dynamics. Rani asserted, "It’s very hurtful for me because my husband made this trust (RK family trust) and gave everything to me. This girl (Priya Kapur) tried to take over everything my husband built all his life."
Allegations Against Priya Sachdev
Rani further alleged that Priya began asserting control over the family business shortly after Sunjay’s death. She emphasized that the company is the culmination of her husband’s hard work and expressed her discontent with someone who became part of their family only recently trying to claim ownership.
Lack of Communication and Potential Settlements
Discussing the possibility of a settlement, Rani stated that there have been no discussions to resolve the matter, indicating that a resolution seems distant. Reflecting on her emotional state, she described the months following her son’s passing as traumatic, revealing that she has not returned to their home in Delhi since his death. She mentioned, "No one from the other side has reached out to me."
Legal Actions: Challenging the RK Family Trust
From a legal perspective, Rani’s attorney, Senior Advocate Vaibhav Gaggar, shared that Rani Kapur has formally challenged the RK Family Trust in court. He pointed out that the trust was allegedly created without her knowledge or consent. Currently, there is no court order preventing the trust from functioning.
Rani’s Rights as a Settlor
Gaggar explained Rani’s legal standing, stating that as the settlor of the trust, she has the authority to remove a trustee without needing to provide reasons. He highlighted that any alterations concerning trustees require her approval, and actions taken without her signature are invalid.
Issuing a Notice Against Priya
Additionally, Rani has issued a formal notice to Priya Kapur to cease her actions as a trustee, claiming that her removal from the trust has already taken effect following the notice period. She has dismissed attempts to exclude her from the trust as legally unfounded.
Rani Kapur’s situation exemplifies the personal and emotional complexities often intertwined in high-stakes inheritance battles. The public and legal scrutiny surrounding this case continues to unfold, drawing attention to family dynamics and the lasting impacts of loss.
